Welcome to the Fabric Plan community at community.fabricplan.com (the “Community”), operated by Lumel Technologies Inc. (“Lumel”, “we”, “us”, or “our”). The Community is a space for planning professionals to learn, share knowledge, and discuss enterprise planning practices and related tools.
By creating an account or using the Community, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Community.
1. Eligibility and Accounts
- You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Community.
- You must provide accurate registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
- You may register directly or sign in using LinkedIn. Use of LinkedIn sign-in is also subject to LinkedIn’s terms.
- One person, one account. Do not create accounts on behalf of others without authorization, or create multiple accounts to evade restrictions.
2. The Community and Your Conduct
The Community exists for constructive, professional discussion. You agree that you will not:
- Post content that is unlawful, defamatory, harassing, hateful, obscene, or that infringes the rights of others
- Post spam, advertisements, or promotional content unrelated to the discussion, or engage in link schemes
- Impersonate any person or entity, or misrepresent your affiliation
- Share another person’s personal information without their consent
- Upload malware or attempt to compromise the security or integrity of the Community
- Scrape, harvest, or bulk-collect content or user data without our written permission
- Use automated means (bots) to post content or manipulate votes, points, or rankings
- Circumvent moderation actions, bans, or access restrictions
- Post confidential information you are not authorized to disclose, including material non-public information about any company
We may moderate, edit, move, or remove content and may suspend or terminate accounts at our discretion to keep the Community healthy, with or without notice.
3. Your Content
- Ownership. You retain ownership of the content you post to the Community (“User Content”).
- License to us. By posting User Content, you grant Lumel a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, adapt, and publish that content in connection with operating, promoting, and improving the Community and related Lumel services.
- License to other users. You grant other Community members the right to view your User Content and to quote or reference it within the Community.
- Responsibility. You are solely responsible for your User Content and represent that you have all rights necessary to post it.
- Persistence. Because discussions are conversational, content you delete may persist in quotes or replies by others, and removal of your account does not automatically remove your posts (see our Privacy Policy for details).
- Feedback and ideas. If you submit ideas, suggestions, or feature requests (including through the Community’s ideas section), you grant Lumel the right to use them freely, without restriction or compensation. This helps us act on community input when building our products.
4. Points, Badges, and Gamification
The Community may award points, badges, ranks, or other achievements based on participation. These:
- Have no monetary value, are not redeemable for cash or goods, and are not transferable
- May be adjusted, recalculated, or removed at any time, including to correct errors or address abuse
- May be discontinued or modified as the Community evolves
Attempting to manipulate or game the awarding of points or badges is a violation of these Terms.
5. Intellectual Property
- The Community, including its design, software, documentation, logos, and content provided by Lumel, is owned by Lumel or its licensors and is protected by intellectual property laws.
- Lumel and related Lumel marks are trademarks of Lumel Technologies Inc. Fabric Plan, Microsoft, and Microsoft Fabric are trademarks of Microsoft Corporation. Nothing in these Terms grants you rights to use any of these marks.
- Documentation and learning materials in the Community are provided for your personal, professional reference. You may not republish, redistribute, or commercially exploit them without our permission.
- If you believe content in the Community infringes your copyright, contact us at privacy@fabricplan.com with sufficient detail to identify the material and your rights, and we will review and respond appropriately.
6. Community Content and Third-Party Information
- Content posted by Community members reflects the views of the individual authors, not the views of Lumel or Microsoft.
- Advice, techniques, and information shared in the Community are provided by peers and are not professional advice. Verify anything important independently before relying on it.
- The Community may contain links to third-party websites and services. We are not responsible for their content or practices.
7. Relationship to the Fabric Plan Product
The Community is a learning and discussion space and is separate from any Fabric Plan product license or subscription. Use of Fabric Plan, Microsoft Fabric, or related products is governed by their own agreements. Nothing posted in the Community — including responses from Lumel staff — modifies any product agreement, creates warranties, or constitutes a commitment regarding product features, roadmaps, or timelines.
8. Termination
- You may stop using the Community or delete your account at any time through your account settings or by contacting us.
- We may suspend or terminate your access at any time, with or without cause or notice, including for violation of these Terms.
- Sections that by their nature should survive termination (including Sections 3, 5, 9, 10, and 11) will survive.
9. Disclaimers
THE COMMUNITY IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE COMMUNITY WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMEL AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE COMMUNITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE COMMUNITY WILL NOT EXCEED USD 100 OR THE AMOUNT YOU PAID US TO USE THE COMMUNITY IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Lumel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Community, or your violation of these Terms or applicable law.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a revised “Last updated” date, and for material changes we will provide additional notice (such as an email or Community announcement). Continued use of the Community after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction and venue.
14. General
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lumel regarding the Community.
- If any provision is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver of it.
- You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
